Temporary Procedures for Electronically Filing Documentary Exhibits Admitted During Video/Telephone Proceedings

The proffering party must upload their admitted documentary exhibits to CM/ECF within one business day after the conclusion of the proceeding. Any objection to the validity of the exhibits must be filed within one business day of the exhibit upload. The procedure for uploading electronically admitted documentary exhibits is as follows:

UNSEALED EXHIBITS:

  1. Counsel must affix an identifying label to the face of each exhibit prior to uploading the exhibits by placing a physical label onto a paper copy and then scanning it to a PDF or by adding an electronic label on the face of an existing PDF document. The label must include the exhibit number and/or letter; the case number; and, when there are multiple plaintiffs and/or multiple defendants, the surname of the party.
  2. Convert the exhibit(s) to PDF format.
  3. File the exhibit(s) in CM/ECF by selecting Other Documents → Exhibits.
  4. Enter the case number corresponding to the proceeding and select Next.
  5. Confirm the case information on the screen is correct and select Next.
  6. Choose the filing party/parties and select Next.
  7. Select either the Telephone or Video radio button corresponding with how the proceeding was held and select Next.
  8. Enter the date of the proceeding and a description of the proceeding, and then use the drop down to select the judge who held the proceeding and select Next.
  9. Review the statement on the screen and select Next.
  10. Upload the exhibits to CM/ECF, and describe the attached exhibit by exhibit number and name. The first exhibit will be the main document. Any subsequent exhibits also should be attached and described thereafter. Select Next.
  11. Select Next.
  12. Approve the final docket text. If correct, select Next.

An example of the final docket text is below:

EXHIBITS admitted during the Video Pretrial Conference held on 6/2/2020 before the Honorable Judge Jane Jones filed by XYZ Corporation. Any objection to the validity of these exhibits must be filed by the next business day following the upload.  (Attachments: # (1) Exhibit 1) (Smith, John)

SEALED EXHIBITS:

  1. Only exhibits that the judge specifically has authorized for sealing may be filed under seal using these procedures. If the judge has not authorized the sealing of a particular exhibit, then the party must seek leave to file it under seal.
  2. Counsel must affix an identifying label to the face of each exhibit prior to uploading the exhibits by placing a physical label onto a paper copy and then scanning it to a PDF or by adding an electronic label on the face of an existing PDF document. The label must include the exhibit number and/or letter; the case number; and, when there are multiple plaintiffs and/or multiple defendants, the surname of the party.
  3. Convert the exhibit(s) to PDF format.
  4. File the exhibit(s) in CM/ECF by selecting Other Documents → Exhibits-SEALED in civil actions OR Other Documents -SEALED→ Exhibits-SEALED in criminal actions.
  5. Enter the case number corresponding to the proceeding and select Next.
  6. Confirm the case information on the screen is correct and select Next.
  7. Choose the filing party/parties and select Next.
  8. Select either the Telephone or Video radio button corresponding with how the proceeding was held and select Next.
  9. Enter the date of the proceeding and a description of the proceeding, and then use the drop down to select the judge who held the proceeding and select Next.
  10. Review the statement on the screen and select Next if you agree.
  11. Upload the exhibits to CM/ECF, and describe the attached exhibit by exhibit number and name. The first exhibit will be the main document. Any subsequent exhibits also should be attached and described thereafter. Select Next.
  12. Review the statement regarding the sealing of the entry and that you will not receive a Notice of Electronic Filing and select Next.
  13. Select Next.
  14. Approve the final docket text. If correct, select Next.

Temporary Procedure for Filing Admitted Pro Se and A/V Exhibits Admitted During Video/Telephone Proceedings

If a pro se or audio/video (“A/V”) exhibit is admitted during a video/telephone proceeding, the proffering party must mail a physical copy of the exhibit to the attention of the courtroom deputy clerk within one business day after the conclusion of the proceeding. The party also must provide a completed and signed copy of the Affidavit for Manual Filing of Exhibits (LF 040) with the exhibit(s).

Note:  Pursuant to LR 79.1(B)(5), the parties must file photographs or other appropriate reproductions of oversized and non-documentary exhibits other than A/V exhibits within ten days after the proceeding.
